MEMBERSHIP AGREEMENT

(Adults & Minors)

1. Parties and Definitions

This Membership Agreement (“Agreement”) is entered into between Original Brazilian Jiu-Jitsu Academy (“Academy”) and the undersigned individual (“Member”).

For purposes of this Agreement:

“Member” refers to the individual enrolling in the Academy.

If the Member is under the age of 18, the term “Member” also includes the parent or legal guardian signing this Agreement (“Parent/Guardian”), who is financially and legally responsible for the Member.

Any reference to “Member” obligations applies jointly to the Parent/Guardian when the Member is a minor.

2. Services Provided

Membership at Original Brazilian Jiu-Jitsu is conditioned upon:

Execution of this Agreement by the Member (and Parent/Guardian if applicable);

Compliance with all terms, conditions, and Academy rules (“Rules”).

Conditioned on the foregoing, Members may:

Attend regularly scheduled martial arts classes, seminars, and related activities during operating hours established by the Academy (subject to change);

Participate in group classes and training sessions offered by the Academy according to the current schedule.

Important Notice:
This is not an open-gym facility. Attendance is limited to scheduled classes or appointment-based training unless otherwise expressly authorized.

3. Membership Payment Terms

All membership fees and schedules are subject to change.

Membership fees are non-refundable.

All membership rates are per calendar month unless otherwise stated and are billed monthly or prepaid as selected.

Membership fees provide access to services, not a guaranteed number of sessions.

4. Service Availability & Attendance Responsibility

Memberships are time-based, not attendance-based.

Fees are due regardless of attendance or usage.

Missed classes do not qualify for refunds, credits, prorations, or extensions.

Classes will continue to be offered as scheduled, and it is the Member’s responsibility to attend.

5. Compliance with Rules

Members must comply with all Academy Rules, which may be posted at the facility, provided in writing, or communicated verbally.

Rules may be modified at the sole discretion of the Academy.

Violation of Rules, unsafe behavior, misuse of the facility, or misconduct may result in suspension or termination of membership without refund.

6. Automatic Renewal & Cancellation Notice

All memberships automatically renew at the end of the current term unless properly canceled.

Any cancellation request must be submitted in writing. Verbal or in-person requests are not accepted.

Written cancellation must be sent either:

By email to [email protected], or

By written letter mailed to the Academy’s physical address on file.

Cancellation is not valid until received and acknowledged in writing by the Academy.

7. Contract Term, Cancellation & Early Termination

Term Commitments

Members enrolling in 6-month or 12-month contracts agree to the full term at a discounted rate compared to month-to-month memberships.

Early Termination

If canceled early, the Member is responsible for whichever is less:

The remaining contract balance (months remaining × contract rate); or

A retroactive rate adjustment applying the standard month-to-month rate to all prior months, with the difference due upon cancellation.

No refunds are provided for unused time.

A minimum of 15 days’ written notice prior to the next billing cycle is required to avoid additional charges.

8. Permissible Cancellations (Legal Exceptions)

Members may cancel without penalty when required by applicable federal, state, or local law, including but not limited to:

Permanent disability or medical condition preventing participation (with documentation);

Other legally protected circumstances under consumer protection or health club regulations.

9. Membership Freeze Policy

Paid-Up Memberships

Members on 3-, 6-, or 12-month paid-up plans may freeze membership in 30-day increments, up to 90 days per term, by:

Submitting written notice at least 7 days in advance;

Paying a $30 administrative fee per 30-day increments freeze.

Freeze pauses access and extends the contract end date accordingly.

Monthly memberships are auto-renewed automatically upon sign up and freezes can be provided to retain package pricing.

10. Minor Membership Terms (Under 18)

This section applies when the Member is a minor.

Parent/Guardian Responsibility

The Parent/Guardian:

Is the financially responsible party for all fees and charges;

Agrees to comply with and enforce Academy Rules on behalf of the minor;

Acknowledges that martial arts involves inherent physical risks.

Supervision & Pick-Up Policy

Minors may only participate during scheduled class times.

Parents/Guardians must ensure timely drop-off and pick-up.

The Academy is not responsible for supervision outside class times.

Only authorized adults listed by the Parent/Guardian may pick up a minor.

11. Emergency Medical Authorization (Minors)

The Parent/Guardian authorizes the Academy to:

Administer basic first aid;

Contact emergency services if necessary;

Seek emergency medical treatment when the Parent/Guardian cannot be reached.

All medical costs remain the responsibility of the Parent/Guardian.

12. Media Release (Adults & Minors)

The Member (or Parent/Guardian for minors) grants permission for the Academy to use photographs or video recordings taken during classes or events for marketing, educational, or promotional purposes unless the Member submits a written opt-out request.

13. Assumption of Risk & Liability Acknowledgment

The Member acknowledges that participation in martial arts involves inherent risks, including serious injury or death.

By signing this Agreement, the Member (and Parent/Guardian, if applicable) accepts full responsibility for participation and agrees to comply with the Academy’s Release of Liability and Assumption of Risk Waiver, which is incorporated by reference widely published.

14. General Provisions

This Agreement represents the entire understanding between the parties.

No oral statements modify this Agreement.

Members must notify the Academy of any billing or contact changes.

If any provision is found unenforceable, the remainder remains in effect.

This Agreement is governed by applicable laws of the jurisdiction in which the Academy location operates.

15. Acknowledgment & Signature

I certify that I am at least 18 years old, or that I am the Parent/Guardian of the enrolled minor.

By signing below, I acknowledge that I have read, understood, and agree to the terms of this Membership Agreement. I understand that participation in martial arts carries inherent risks, and I accept full responsibility for my participation as outlined in the Academy’s Release of Liability Waiver.

I consent to receive messages related to my account, orders, or services I have requested. There messages may include appointments remainders, order confirmations, and account notifications among others. Messages frequency may vary & data rates may apply

I consent to receive marketing and promotional messages, including special offers, discounts, new products updates among others.
